Applying for a USA Investment Visa is one way those who qualify can gain admission to and the right to reside in the United States. There are temporary options for investors, but the way to gain permanent residency is through obtaining an EB-5 immigrant investor visa.
To do so, here is the information you need to know.
How to Qualify
To qualify for an EP-5 Investor Visa, the applicant must make a minimum qualifying investment of $1,800,000 (or $900,000, if the investment is in a targeted employment area) in U.S. dollars into a for-profit business.
The business must create 10 or more full-time jobs within two years of the investor’s investment in the business. The qualifying employees must be legally authorized to work in the U.S. The investor, their spouse, and their children may work at the business but they do help satisfy the 10 employee minimum.
Every year, the USCIS can process up to 10,000 EB-5 Visas, but there are limits on the number of visas that can be approved for investors of individual countries.
The first step in obtaining a business visa as an investor is to file a petition with the U.S. Citizenship and Immigration Services (USCIS) using Form I-526. Once the petition is approved, the investor must pay the fees and file their Immigrant Visa and Alien Registration Application (Form DS-260), along with all the required documentation.
Comply with Medical Requirements
Prior to appearing for their interview, the investor must submit to a medical exam before an embassy-approved physician and receive all required vaccinations. Applicants from individual countries may have additional medical requirements that must be met.
Appear for an Interview
Once the application process is complete and all fees and documents provided, the EB-5 investor will get an in-person interview. After the interview, the officer conducting the interview will decide whether the investor is eligible to receive the visa.
What Happens After the Visa Gets Approved
If the EB-5 Investment Visa gets approved, the USCIS Immigrant fee must get paid. Only then can the investor travel to and request entry to the U.S. Once admitted to the U.S., the USCIS will mail their green card to the investor. The formal name for the green card is a Permanent Resident Card, Form 1-551. And you can also use the Self-sponsored Green Card program in order to get a quicker approval to reside in the USA, so that’s also a great option.
At this point, the investor is entitled to apply for a Social Security Number. If this election was made on the investor’s original visa application, there is no need to reapply. A Social Security Number Card will be mailed to the address provided by the investor.
